Curfew Ordinance
Sec. 66-333. Curfew.
- It shall be unlawful for any minor under 17 years of age to loiter, idle, congregate or otherwise be in or on any public street, highway, alley, or park, or any public place, between the hours of 12 midnight and 6 am, or for minors 15 years of age or under to be in such place from 10 pm to 6 am.
- The curfew established by subsection (a) of this section does not apply if the minor is:
- Accompanied by the minor’s parent or guardian or an adult designated by the minor’s parent or guardian.
- On an errand at the direction of the minor’s parent or guardian or an adult designated by the minor’s parent or guardian, without any detour or stop.
- In a motor vehicle involved in interstate travel.
- Engaged in an employment activity, or going to or returning home from an employment activity, without any detour or stop.
- Involved in an emergency. In this subsection, the term "emergency" means an unforeseen combination of circumstances or the resulting state that calls for immediate action. The term includes, but is not limited to, a fire, a natural disaster, or an automobile accident, or any situation requiring immediate action to prevent serious bodily injury or loss of life.
- Attending an official school, religious, or other recreational activity supervised by adults and sponsored by the city, a civic organization, or another similar entity that takes responsibility for the minor, or going to or returning home from, without any detour or stop, an official school, religious, or other recreational activity supervised by adults and sponsored by the city, a civic organization, or another similar entity that takes responsibility for the minor.
- Exercising First Amendment rights protected by the United States Constitution, such as the free exercise of religion, freedom of speech, and the right of assembly.
- Married or had been married or had disabilities of minority removed in accordance with law.
- Any person assisting, aiding, abetting or encouraging any minor under 17 years of age to violate the provisions of the curfew established by this section shall be guilty of an offense, and when any minor is found violating this section a presumption shall arise that the parent or legal guardian having the care and custody of the minor assisted, aided, abetted and encouraged such minor in so violating this section.
- The parent or guardian of any minor child under 17 years of age shall be held responsible for the enforcement of this section.
- Any parent or guardian found guilty of violating any of the provisions of this section shall be punished in accordance with section 1-8. Any minor violating the provisions of this section shall be dealt with in accordance with juvenile court law and procedure.
